Terms of Service
These Terms of Use (the “Terms”) govern your use of the SpotEarth mobile application (the “App”). By downloading, installing, or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the App.
1. Service
SpotEarth is a GPS navigation and mapping application. It uses your device’s location services to display maps, calculate routes, and provide navigation, as well as other features available from time to time. The App is provided “as is”, and its feature set may change over time.
2. No Account Required
You do not need to create an account, register, or sign in to use the App. We will not ask you for your name, email address, or other personally identifiable information to provide core functionality.
3. License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to download, install, and use the App on devices you own or control for your personal, non-commercial purposes only, subject to Apple App Store usage rules.
4. Acceptable Use
You agree not to:
- Use this application for any illegal purpose or in violation of any applicable law or regulation;
- Copy, modify, reverse engineer, decompile this application, or create derivative works thereof;
- Rent, lease, sell, redistribute, or sublicense this application;
- Interfere with or damage this application or its servers;
- Use this application in any way that may harm, disable, or weaken this application or interfere with others' use of this application.
5. Location Data and Permissions
The core functionality of this application relies on location services. You can control location access permissions through your device settings and grant or revoke permissions (including precise and approximate locations) at any time. Some functions may not function properly without access to location information. For more information on location data and other data processing methods, please see our Privacy Policy.
6. Driving Safety
Do not use this application in any way that may distract you from safe driving. Always obey applicable traffic laws and road signs. Route guidance, maps, traffic information, speed limit instructions, and other content are for informational purposes only, and we do not guarantee their accuracy, completeness, timeliness, or safety. You are solely responsible for your driving decisions and safety.
7. Third-Party Services and Content
This application integrates third-party services, such as map and advertising providers. These services are governed by their respective terms and privacy policies, and we are not responsible for their content, availability, or practices. Map data, points of interest, traffic information, and images are provided by third parties and may be inaccurate or outdated.
8. Advertising
This application is free and supported by advertising. We and our advertising partners may display advertisements, which may include legally permissible, interest-based advertising, subject to your device settings and your consent. We are not responsible for the content of third-party advertisements or any advertised products or services.
9. Intellectual Property
This application (including its software, design, text, graphics, logo, and other content, excluding third-party content) is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws. You have no other rights except for the limited license described in Section 3.
10. Disclaimer
This application is provided "as is" and "as available" without any express or implied warranties of any kind, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. We do not warrant that this application will be uninterrupted, error-free, or free of harmful components, nor do we warrant the accuracy or reliability of maps, routes, traffic, or other information.
11. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, loss of data, or loss of use, arising out of or related to your use of or inability to use this application, even if we have been advised of the possibility of such damages. In no event shall our total liability exceed the amount you paid for this application (if any).
12. Apple's Terms
If you downloaded this app through the Apple App Store, you acknowledge and agree that: (a) these Terms are solely between you and us and not with Apple; (b) Apple has no obligation to maintain or support this app; (c) to the extent permitted by law, Apple assumes no warranty obligations regarding this app; (d) Apple is not responsible for handling any claims made by you or any third party concerning this app; and (e) Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you.
13. Termination
We may suspend or terminate your access to this app at any time, without justifiable reason. You may stop using the app at any time by deleting it from your device. Articles 9 through 13 and 17 will remain in effect after termination.
14. Changes to Terms
We may update these Terms from time to time. In the event of significant changes, we will notify you via in-app notifications as appropriate. Your continued use of the app after the changes take effect constitutes your acceptance of the revised Terms.
15. Severability and Entity of Agreement
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding this application.
